Here are some of the important load-out dates and timings you need to know for our Public Auction:

Saturday: After the conclusion of the auction until 5:00 PM CT, or whichever comes first
Sunday: Following the auction date from 10:00 AM – 2:00 PM CT

You MUST have a PAID receipt from Kiefer Auctioneers to pick-up your lot items.
Any other pick-up arrangements must be made with auctioneer immediately after the auction to avoid forfeiture of your purchases. Contact the Auction Company at 940-391-9111 or 903-821-8717.
All lots must be removed within the stated load-out period listed on your invoice. Failure to remove items by the deadline will result in forfeiture of your purchase and waiver of all rights to the property. No refunds or exceptions will be granted.
FIREARM TRANSFER & COMPLIANCE POLICY:
All firearm sales are conducted in strict compliance with applicable federal law, Texas law, and regulations enforced by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
All firearms purchased at auction must be transferred through:
5R Precision Firearms, LLC By Appointment Only
Firearms will only be released upon presentation of a Paid Invoice issued by Kiefer Auctioneers and completion of all required transfer procedures.
FEDERAL LAW COMPLIANCE
Pursuant to the Gun Control Act of 1968 (18 U.S.C. § 922 et seq.) and applicable ATF regulations:
• All retail purchasers must complete ATF Form 4473 • A National Instant Criminal Background Check System (NICS) verification must be conducted, unless exempt under applicable federal law • Firearms will only be transferred to the individual named on the Paid Invoice • No firearm will be transferred in violation of 18 U.S.C. § 922(g)
Retail purchasers must receive an approved transfer status prior to release of any firearm.
TEXAS LAW COMPLIANCE
All transfers will comply with:
• Texas Penal Code Title 10, Chapter 46 • Texas Government Code Chapter 411 (where applicable) • All other applicable Texas statutes
Possession, transportation, and ownership remain subject to Texas law.
AGE REQUIREMENTS
• Must be at least 18 years of age to purchase long guns • Must be at least 21 years of age to purchase handguns Unless otherwise permitted by applicable law.
FFL HOLDERS
A purchaser who possesses a current and valid Federal Firearms License (FFL) may take possession in accordance with applicable federal law, provided a physical copy of the FFL is presented at time of transfer.
All transfers remain subject to federal compliance requirements.
TRANSFER FEE
A $35 transfer fee per firearm will be charged by 5R Precision Firearms, LLC.
This fee applies to all purchasers, including FFL holders, unless otherwise agreed in writing by the transferring dealer.
SHIPPING & OUT-OF-STATE TRANSFERS
Any firearm not picked up in person must be shipped to a licensed FFL dealer in the purchaser’s state of residence in accordance with federal law.
Interstate transfers will only be made to a valid FFL.
Purchaser is responsible for:
• Shipping • Handling • Insurance • Receiving dealer fees • All related transfer costs
PROHIBITED PERSONS
Firearms will not be released to any person prohibited from possession under federal or Texas law, including but not limited to individuals described under 18 U.S.C. § 922(g).
NICS DENIALS OR DELAYS
A NICS denial or inability to complete transfer does not relieve the purchaser of payment obligations.
If a transfer cannot be completed, the firearm must be:
• Transferred to a qualified FFL • Resold at the purchaser’s risk • Or otherwise disposed of in accordance with applicable law
Any resale, restocking, storage, or administrative costs may be deducted from proceeds.
FAILURE TO COMPLETE TRANSFER
Failure to complete the transfer process within the stated timeframe may result in forfeiture of the firearm and any payments made, to the fullest extent permitted by Texas law.
INDEMNIFICATION
To the fullest extent permitted by Texas law, purchaser agrees to indemnify, defend, and hold harmless Kiefer Auctioneers, the Seller, property owners, and their officers, agents, and employees from any claims, liabilities, damages, or losses arising from the purchase, transfer, possession, handling, transportation, storage, or use of any firearm purchased at auction.
FINALITY OF SALE
All firearm sales are final.
No refunds or returns will be permitted.
All sales remain subject to applicable federal law, Texas law, and international treaty requirements (including C.I.T.E.S., where applicable).
Kiefer Auctioneers is not responsible for delays caused by background checks, regulatory compliance, shipping, or dealer processing timelines.
Shipping:
If you require shipping, please notify the Auction Company immediately following the auction. The buyer is responsible for all associated costs, including a handling fee charged by the Auction Company, as well as freight and packaging fees charged by the shipping carrier.
A $25 handling fee applies to each lot requiring shipment.
For oversized items or lots requiring special crating/packaging, a $50 handling fee per lot will apply. It is the sole responsibility of the purchaser to coordinate and arrange for a shipping company to pick up any large or heavy (crated) items within the stated pick-up days and times.

Once an item is declared sold, the Auction Company assumes no responsibility for damage or loss incurred during shipping. By purchasing, the buyer accepts full responsibility for the item(s) and agrees to release and indemnify the Auctioneer and Auction Company from any claims, damages, or liabilities of any kind.
Essential Points To Remember!

You must notify the Auction Company by 5:00 pm on the day of the auction how you will be paying by calling or texting (940) 391-9111. Please leave a detailed message stating your name and bidder number, how and when you will be paying, or to run your card on file. All payment arrangements must be made within 24 hours after the conclusion of the auction to avoid your card on file being run.
Wire Transfer must be received by the auction company the following business morning after the auction. All payment information and wire transfer instructions will be emailed to all winning purchasers after the auction from Kiefer Auctioneers (not ProxiBid), so please check your junk and spam folders.
You may pay with cash, check with a bank letter of guarantee, or credit card with a 3.79% convenience fee
All financing MUSTbe in place PRIORto the Auction – You can apply for financing on our Financing tab on our homepage prior to the auction date (Please allow enough time for processing your requested loan amount).
Make sure your TAX EXEMPT information is CURRENT on your ProxiBid account; otherwise, you will be charged taxes until it is updated. No exceptions will be made. All sales destined for states that qualify for resale or agricultural use may be exempt from sales tax, provided the purchaser submits a valid exemption form for the applicable state. If you receive an invoice showing sales tax and you hold a resale or agricultural exemption in your state, you must supply us with a completed and signed exemption certificate. Upon receipt and verification, the sales tax will be removed from your invoice. Sales tax will be collected per state regulations, tax rate is determined by the physical location of the item(s).
